How much can be garnished from a VA disability check?
Dear Jim,
How much can be garnished from a VA disability check in the state of Illinois for 4 children? Is it a percentage or just the amount the VA allocates for the children that is added to the check? Thank you for your time!
Reply:
VA payments can't be garnished. There is a process known as apportionment that the VA will consider if you apply for it.
The amount is based on a formula of how much the veteran owes (by the order of a court) and his resources. The VA will always protect the interests of the veteran as they consider apportionment actions. He will be left enough to live on if VA apportions any money.
