TDIU and static rating
Question:
I received TDIU for PTSD that’s Static. Is my spouse eligible for Champva?
Jim's Reply:
The term static is often used to indicate a rated condition that isn't improving over time and probably won't. The term isn't usually used when we're talking about ratings, we usually will say 'permanent'. In other words, a static condition may earn a permanent rating.
If your TDIU rating says that there are no future exams scheduled and that dependents are eligible for Chapter 35 DEA and/or CHAMPVA, you're good to go. If you have a future exam noted or there is no reference in your award letter to Chapter 35 DEA or CHAMPVA, your rating is likely a temporary one and dependents will not be eligible for the CHAMPVA benefit.
