TDIU and Return To Work

Question:

I am currently on TDIU. I can't find anything that's not vague on returning to work. Can you tell me who to contact and what the regulations are, please? Thank you

Jim's Reply:

I'm not sure what you mean by "who to contact"? What do you want to accomplish? The VA has a toll free number you can call but to be honest, it's not known to be very reliable.

In any case I think that the rules are fairly simple...the veteran who is receiving the TDIU or Unemployability benefit is allowed to work and earn up to the federal poverty level for their region. The latest guidelines are here

While you're receiving the TDIU benefit, the VA will cross match your SSN with the SSA/IRS to learn if you've reported taxable income and if it exceeds the poverty guideline. If you earn above that line, VA may propose to reduce your benefit.

While everyone would like to see every veteran do productive work the VA doesn't have a "return to work" program set up as nicely as the SSA does. If you're able to return to full time or gainful employment, do so recognizing that eventually VA will catch up to you and probably propose to lower your rating.

You can learn more about the TDIU benefit here  and the rule book is here
