VA disability being offset

Question:

Jim, My VA disability is being offset because I received severance pay upon leaving the military. The crazy thing is, it looks like they are offsetting my disability payments for any temporary increases I've had as well. I can see having to pay back the severance, but to pay back any money after that fact, makes me wonder what they are doing. I've never received my full compensation and I've been out since 2002.

Jim's Reply:

I'm not sure I follow you? The system requires that any overpayments will be clawed back and that's often done by taking all or part of disability pay. Often enough,  VA will only take part of the money rather than all of your disability check and of course that means they'll be pecking away at it for a long long time. That you've been out as long as you have is concerning, you either had one heck of an overpayment or mistakes have been made.

In any case, petition for a reduction here and see what happens. Follow the instructions and you may have it all waived. Click here for more information.
