VA malpractice
Question:
My husband died as a result of a VA doctor's actions. Since I was unable to find a Tort lawyer I filed the SF 95 myself. It was denied. How can I file an appeal? I'm still unable to find a lawyer to help. Just need someone to walk me through the process. Also, I saw the information about the 1115. Can I file that even though I did the 95? Thank you.

When we believe we have a medical malpractice case, it's wise to turn to attorneys who specialize in tort claims and it sounds as if you've done that. When the specialty lawyers turn us down, we have to take a step back to consider whether we have a legal case or an emotional trial we're going through. Knowing that you've already filed for yourself and that other lawyers have turned you away, I can't think of any way I could help you. Nobody who is a responsible professional will 'walk you through the process' because that could be interpreted as counseling you. You can file an 1151 claim yourself but from what you've said already, I don't know that it will help. Good luck.
