Married for 33 years to 100% disabled vet
Question:
I have been married to my husband 33 years. He is rated 100% disabled by the VA. It has not been 10 years yet that he has received his disability pension. Is it true that if he passes away or we divorce I will not receive his pension? I have read your article about divorce, but it did not mention about a time period for divorce.
Jim's Reply:
No, you will not receive his disability benefit under any circumstance (he doesn't receive a pension). If he dies of a service connected condition, you will be eligible to apply for DIC, a survivors benefit. If you divorce or he dies of something other than a service connected condition, it all gets much more complex. Read about DIC here
