Question:
In your response to a question titled "TDIU and Substantial Gainful Employment" dated 11 April, 2019. You pointed out that the VA finds ways to punish veterans for failing to file VA Form 21-4140 on an annual basis it becomes a problem nobody wants. It's my understanding that this has changed and VA no longer requires this form to be sent in anymore unless it's warranted. VA as you know is a huge bureaucracy. Are you suggesting we file 21-4140 anyway to cover our backs and give the new process time to adjust? Thanks for all you do for us veterans.

Yes. I've long offered that it takes about 5 minutes and a small certified mail fee to send in an annual VA Form 21-4140. Once you've done that you know that you're less likely to have any issues with your TDIU rating. VA has started to replace the 4140 by confirming our lack of gainful employment by checking our SSA & IRS records. But the system isn't up to speed yet and I'm getting a number of reports of flagged accounts for various reasons. Sending in a 4140 is a simple and cost effective insurance against future problems.
