Wife facing divorce with questions about BAH

Question:

Hi I am currently going through a divorce because verbal and mental abuse from my husband and one of my problems is I have not seen any of the bah money he collects for being married. I live in Alabama due to reasons I can’t be in Alaska with him but my question is if he is stating he has collected BAH yet and if he truly hasn’t does he still owe me that money? I am former army and my cousin has been in almost 20 years and said that when he spoke to legal they told him that he is to pay even if he is collecting BAH yet so I just would like to get the facts. Thank you.

The divorce court is the only place that these decisions are made. The court will consider all income of both parties to determine who will pay how much to who. As a rule, the court will consider all income when determining those amounts so be sure that it's included in any financial statement.
