What if service member has signed a certificate with seal saying they would pay so much during separation, then didn't do so.  Do you have to go through civil court if they are retired?

If you're separating and breaking up a marriage, you have a civilian problem and you need to speak with a civilian lawyer. The civil court you're thinking of is divorce or family court for problems relating to marital issues.
