Dismissed without cause
Question:
Mr. Jim, I'm retired from the State of California (Prison Industry Authority) and have work as a Retired Annunitant for (8) years. However I was dismissed on my last assignment by an Administrator because he wanted me gone on a personal decision of his. He call it (Termination Without Fault-Separation) without any notice and refuse to give me a reason. I know that the Personnel Action can be Terminated at anytime between the parties, but I though that there would be a reason for the action, as I did not have any letters of recommendation, or disrespect of staff, nor any other actions taken against me. The State Personnel Board (California) said that they couldn't do anything about this action. As a retired person with a clean record, I don't see how this person whom I was on loan to, could dismiss me without cause.
Jim's Reply:
My expertise (such as it is) is pretty limited to how we work with The Department of Veterans Affairs (the VA) to assure that we are awarded the benefits we've earned. Your issues seem to be an employer/employee dispute and that's a giant field of legal knowledge to itself. If you want to pursue this for legal action you need to talk with a lawyer who is experienced in employee/employer disputes. Once you've done that you'll know the options you may have open.
