Fleeing Felon rules

Jim,

I was reading one of your news letters where you had an attorney who handled legal affairs for veterans such as arise under the fugitive felon program. I have need of such an attorney. In 2006 I received such a letter. In June of 2006 my benefits were stopped. I had responded to this letter and provided documentation showing this matter had been taken care of. Because of the state courts actions all adverse action by the Veterans Administration should have ceased yet benefits were stopped. I had asked for a hearing and was denied, all evidence was discounted. Under the policy of RES JUDICATA no one could take any action. This constitutes double jeopardy. Now I have to vindicate my rights in federal court and have been trying to do so since 2008, yet every time I file something a particular judge is assigned and he throws it out. My life is such a legal and financial mess I will lose everything in another year or so. At this point I am desperate and really need help.

I advise you to start by reading my work on the pages here http://www.vawatchdogtoday.org/Fleeing_Felons.html

The VA "fleeing felon" or "fugitive felon" rules are singularly unfair and make no sense at all. The SSA has a similar regulation but it's enforced using a dash of common sense.

To my knowledge there have been few if any successful protests by any veteran who has been caught up in the VA process unless the vet has followed the procedures that I've written down for you. I know a number of vets who have used the nunc pro tunc prcedure and once they have the order of the court, VA relents and clears up the record. I know of no other procedure that will help.

The attorneys I work with will not accept fleeing felon cases until you have done all the homework of the nunc pro tunc process yourself. If you will read and follow the instructions and if you have no luck doing that, write back to me and I'll try to refer you to a lawyer.
