Victim of domestic violence by husband/veteran

Question:

My soon to be ex husband tries to kill myself and our children. He is waiting for the trial to begin...my question is he is a VET and I want to know if I can put in our divorce decree that I am entitled to his full military benefits upon his death? I don't want child support or alimony. Is this possible?

Jim's Reply:

You aren't entitled to his benefits on his death. There is no law that would allow such a thing. The divorce court and the VA will determine what, if anything, you may be owed.
