VA treats appeal as a new claim

Question:

Hello, Back in 2014 my husband received a rating of 40% for PTSD. He then appealed the rating percentage within the allotted time frame and followed the VA's process. After over 5 years of waiting for the VA to make a decision on his appeal, his rating was raised to 70%. Unfortunately, we believe the VA is treating his appeal as a whole new claim so they are not back paying the difference, which would be about $50,000. Is this something we should appeal, or am I missing something? If we should appeal, how should we go about this? We have reached out to the DAV and other organizations and haven't received much help or guidance. I appreciate your help! Thank you!

Your husband really needs this reviewed by a veterans law attorney. That won't cost anything and could gain him a lot of benefit. Click here.
