Question:
Hello, I am trying to find out if I can apply for a temporary 100% disability with the VA. I am currently working but my back condition is deteriorating and I am in severe pain (currently in ongoing treatment). Am I eligible to get temporary 100% disability until I find sedentary employment?
Jim's Reply:
If you are currently working you'll have a hard time convincing anyone you aren't able to work. I understand that you may not be comfortable and so on but, at the same time, if you are at work today, the argument that you can't work doesn't hold up so well.
The first thing you have to do is to file a claim for your back condition. Then, if that is a service connected condition you'll be rated from 0% to 100% disabled. In any case, there is no temporary disability in the way you describe it.
