Question:
Can the VA rate you 100% schedular for md and still be TDIU? On the decision letter from TDIU 70% major depression to 100%. But never stated on letter if it is TDIU because the letter generated from e-benfits still shows “you are being paid at the 100% rate because you are unemployable due to your service connection disability” and everything else updated. Is it possible to be schedular 100% and be TDIU? So does that mean you can’t work?
Jim's Reply:
The phrase, “you are being paid at the 100% rate because you are unemployable due to you service connection disability”, means that you are TDIU. It does not say that you are 100% schedular. You are not allowed to work at gainful employment.
