Question:
Hi Jim. I was hoping you can help me out with my situation. I’ve been 90% but paid at the IU rate of 100% and just recently I received a long awaited decision for sleep apnea which was granted at 50% and brought up my combined rating from 90 to 100%. Does this automatically take me off I.U. Rating since I’m now 100% through combined rating?
Jim's Reply:
I don't know...maybe, maybe not? But yes, it's most likely you have a schedular rating now. I'd have to know the sequence and rating % of each of your other ratings to be sure. You can do the VA Math for yourself here at the Combined Ratings Table.
So you know...I don't think the rating change from TDIU to a schedular 100% is at all important. The only difference is that if you are 100% schedular, you can work as you please. If you're 100% TDIU you aren't allowed to do that. Otherwise, it's the same rating...no difference. Most vets who are 100% disabled don't plan to return to gainful employment so it's kind of moot.
