TDIU and Small Business Rules

Question:

Hi Jim. I'm currently receiving tdiu benefits. I was thinking about starting a business, when I read an article you did. Is it possible to do this without messing up my tdiu? If the business is seperate from me and I pay myself a small amount or even not at all? Would it even be considered a seperate entity or all income? Thanks.

Jim's Reply:

There are as many ways to set up a business as you can think of. VA knows them all and will ultimately look at your personal taxable income. If your personal taxable income is below the threshold for the federal poverty level in your region, you shouldn't have any issues.

But to say you shouldn't have any issues doesn't mean you won't. VA may want to look closer to be sure you aren't hiding income or some such as that. More is here https://www.va.gov/disability/eligibility/special-claims/unemployability/
