Question:

I just received notification of a CONUS mobilization for 365 days. This starts at the end of the year. We need to get things taken care of such as IDs, power of attorney, and other legal stuff. My spouses employer is threatening her with termination if she takes any time off to do these things. I know FMLA only covers OCONUS mobilizations so what if any protections does my wife have?

Jim's Reply:

I'm sort of doubtful that there are any built in protections for your spouse under these circumstances. Your best bet is to check with your JAG offices as you are able. The JAG may be able to offer solutions.
