Question:
Jim, I am receiving DIC as of May, 2018. I do not agree with effective date of 2012. My husband was diagnosed with the terminal disease in 2003. He had to retire from federal job and was dead in 2010. Can I argue that facts were before the board when VA first denied claim 2 times! He had FTD and I won claim with 3.156! He was never able to do anything and it was difficult for me, I have Multiple Sclerosis. I thought I would be dead before I ever had hearing. Hearing was 12/2017. It took all of our savings and more to meet his needs. I am overjoyed and appreciative of what I received, but believe I am entitled to more not for me but for the only child we have, now with adult onset Diabetes and insulin dependent. Please, help us?? I'm sorry but your story isn't making sense to me. It sounds as if you've had a difficult time dealing with VA but I can't tell if you've been wrongly denied the correct effective date or not. In any case, your next step should be to locate an accredited veterans law attorney and ask that person to review your case for any possible appeals of the effective date. A veterans law attorney as your advocate is your very best bet!
