Below are some frequently asked questions regarding the current status of the CDC eviction ban and what to do if your eviction is related to the COVID-19 pandemic. 

Is there a nationwide eviction ban?

No. On August 26th, 2021 the United States Supreme Court struck down the new CDC Eviction Moratorium. This means there is not any kind of ban on evictions. 
 

You should call your local legal services provider (LSC) for help with any questions or if your landlord is trying to evict you.   
 

I can't pay my rent. Where can I get help? 

You should apply for assistance through your local housing program or you can find organizations near you that offers Emergency Rental assistance. 
 

If you do not qualify for Emergency Rental Assistance, there may be other agencies and programs in your state or local area that can help. You should reach out to the closest organization near you that provides Emergency Rental Assistance and they may be able to give you some resources.
 

I was told I wasn't eligible for the rental assistance program before August 2021. Should I reapply?

Maybe. Each state is different and you should reach out to your local housing program or find organizations near you that offers Emergency Rental assistance to find out if you should reapply. Even if you still don't qualify, they may be able to offer other resources to help.
 

Does this action by the Supreme Court affect SCRA Protections?

No. The Servicemembers Civil Relief Act (SCRA) is a law that helps protect members of the military and their families from financial and legal harm because of military service. The CDC order was completely separate and not specific to military service.  You can still use the housing protections under the SCRA.
