VA Form 21-2140

Question:

Has this rule changed in 2020 as I was awarded IU This year and have been marked as P&T on my decision letter. It is now 60 days to the date of my award and I am not sure If I should contact the VA and request a VA Form 21-4140. Being P&T, I didn't think I had to fill one out. Any help would be great and thank you in advance.

Yes, the rule has changed. You aren't required to return an annual VA Form 21-4140 any longer. The VA has started a program of matching your income with the IRS and SSA. If you become employed or earn more than the federal poverty wage, VA will send you a 4140 to return and they'll take your over-earnings from there.

P & T has nothing to do with it. If you are a beneficiary of the TDIU benefit whether a temporary or a permanent rating, you aren't allowed to work at gainful employment.
