My ex husband just started receiving VA benefits. He owes me $40,000.00 in back child support. Am I entitled to a small portion of those benefits? Thank you

You may be entitled to a portion of those benefits, yes.
While VA disability pay can't be garnished in the traditional sense, if you submit the proper paperwork, some of that money may be apportioned.
You must accurately and truthfully compete and deliver this form. You must good provide evidence that child support payments are past due. This might be an accounting from your state child support services or some similar official documentation of what is owed. The better your documentation the better your chances of a generous allotment.
When you've completed the form make a copy to keep and using certified mail with return receipt requested, send it to;

Once VA receives that form they'll contact your ex to advise him what's up. He'll have to complete a financial statement and VA will then make a decision of what they may do and you'll be notified.
