Question:
Hello Jim, It seems to be taking for ever to get the results on my claim. It was originally filled on May 17 2013. The claim was denied twice, I requested a hearing and on 13 August 2019 I had my hearing. The judge granted my shoulder injury, but I have to wait till the other two items are finalized. On December 9, 2019 I had my second VA C & P exam. The doctor stated it was more than 50% likely that my PTSD and Barrett’s esophagus under a secondary cause. The VFW who represent me said I have a very good chance of winning that one and a 50% chance of increasing the disability on my right ankle. My question is how long should I wait for an answer? What would be my next step?
Jim's Reply:
"how long should I wait for an answer?" Until you have an answer. "What would be my next step?" Wait for the decision. I'm not sure there are any alternatives to that.
It's unfortunate that your case has gotten caught up in the system but it happens often enough that I can tell you yours isn't delayed as long as many are. The process of appeals at VA invites logjams and delays that last for months, years and even decades. The system of remanding unfinished business back and forth between a regional office, the BVA and the appeals management center seems designed to fail and you're right in the middle of it.
There is nothing to be done except to wait. It's my experience that, as soon as you begin to raise a fuss about your long delay, it may result in actions ending up with even longer delays. My advice: Do nothing and keep your fingers crossed.
