I saw your answer to the issue: "Retirement income is not a factor in the TDIU decision" I know that SSDI isn't a negative factor in a TDIU decision, but what if a person is 70 years old, is 90% service connected and otherwise meeting the disability rating requirements, but receives normal SSA(SS retirement)? Thanks for any help, Jim p

If it isn't gainful employment, income, assets and wealth don't factor into a TDIU decision. A 70 year old who applies for TDIU may be denied because most 70 year olds are retired and not seeking employment. If you aren't actively seeking employment, it's difficult to prove you aren't being hired because of your disability.
