Remands

Question:

What's your handle on remands?  A claim filed by my attorney stated the TDIU awarded to me in 2009-2016 should have initiated back in 200 .when I was released from my job due to s/c disability.   I received a 90% rating and paid 100%. BVD reads TDIUprior to 2009 be remanded. Also, TDIU claim be sent to Director of Compensation for extra-scheduler consideration prior to 2009. This claim should be readjudicated.

Jim's Reply:

A remand is an order telling the next lower decision making body, the one that made an earlier decision, to do it again and review these potentially missing parts. In other words, the claim will be readjudicated. Whether or not your claim should be effective on a given date will depend on when you filed it and very little else.
