"Over 55 rule" and current rating

Question:

I am a Viet Nam vet 70 yrs old I have diabetes and had my prostate removed due to cancer. I was receiving 100% but have to go for a reexamination. After 1 yr I am still extremely incontinent. The inside of my thighs are numb and I have to wear a diaper and a pad that I change frequently. What can I expect after the exam? Does the over 55 rule come in to effect?

Jim's Reply:

There is no "over 55" rule...that's a common myth that veterans have spread for years. When we have a service connected cancer, we are rated at 100% temporary. When the cancer is cured, we are allowed to recover and rehabilitate at that 100% rate and then we're reexamined to determine a final rating. The final rating for prostate cancer after treatment is usually 40% or 60%, depending on how many pads you require each day.
