Can your VA disability be calculated in child support?

Yes. Most states divorce courts require knowledge of all income including VA and/or any other disability payments. That total is then used to determine the amount of any obligations...who owes what to who. No matter what you may hear, it is not illegal to calculate obligations this way even though VA disability money can't be directly garnished. If we don't follow the orders of the court, VA disability money may be apportioned and although the process is different than garnishment, the end result is the same. It's easier to follow court orders than to get behind and deal with the system.
