Uniformed Services Former Spouse Protection Act

Question:

Hi Jim, not sure if you can help me or not but I want to ask a question in regards to USFSPA. My husband retired after 22 years of service - I was married to him the entire span of his career. When we had been married for 29 years we went through a divorce. I tried everything on my own to find out about the benefits that were available to me, but had a difficult time getting the right direction. I wasn't aware of until recently that during that time I should have filed to become my own sponsor within 90 days. Ten months after our divorce we were remarried to one another again, and we have been married now for four additional years. I'm not certain my marriage is going to make it at this point, and I'm concerned about whether or not I will still have access to my spousal benefits (mainly Tricare Prime) even though I remarried. The caveat here is that the person I remarried was the same person who was my original sponsor. Have you come across this scenario at all? Thank you for your time.

Jim's Reply:

I've not come across this particular scenario and I'm sorry but I'm not at all sure how to answer you. You may want to pose that question to an expert on military divorce here.
