Question:
Rating came back 100% total. But box on eBenefits is checked "not permanent, not total." Will dependents be eligible for CH 35 education benefits based off 100% rating? Or does it need to be P & T?
Jim's Reply:
It's unfortunate that the eBenefits site so often gives us bad data. I've learned that eBenefits can be helpful for some functions, but it gets a big fail for providing accurate info. I always rely on the letter that is mailed to us in the traditional BBE...Big Brown Envelope.
If your letter says that "no future exams are scheduled", your rating is permanent. Chapter 35 DEA does require that the veteran be 100% disabled as a permanent rating (P & T); a temporary 100% rating won't provide that tier of benefits.
