Question:
I am going through a custody battle with my husband. He is currently active duty and I am receiving 100% disability. Do I have to let the courts know that l'm receiving disability and is there a way they can find out if l don't tell them?
Jim's Reply:
Yes, you must disclose ALL income, including (very specifically) VA disability money. If you didn't report it as you're suppose to you'd find yourself in contempt of a court order and you'd then have to explain that to the judge. The judge has seen it all and knows you'll try to hide that money...don't do it. He'll tell them anyhow and you'll pay the price for hiding money. There's little worse than dealing with an upset family court judge.
