Major problems with housing closing

Question:

I had a loan through my bank Navy Federal. I found a house and started the closing process. Was 1st to close on Dec 20 2018- but the Realtor Kim ask me to delay because she was trying to coordinate getting her 3 aunts she was handling to agree- so I agreed to a January 10th closing. But the loan officer Daniell found out the house was not even clear to sell because there was no clear title. The bank officer prior to this kept saying seek legal help. Now they refused to get a survey which the VA surveyor found out prior to learning after the loan officer finally calls the so call closing attorney is the probate attorney and the saints are not the legal owners of the property. Now I have to start this loan process all over. Thus Realtor Ms Kim knew there was no clear title and once us was out she says they refused to get a survey of the land. I believe as a professional Realtor she knew this and thus house should not of even been on the market and especially putting me through 4 months and causing me to lose this Loan and start all over. This is causing great hardships and having to start the whole thing over. What are my legal position. I want to take her to the realtor yo court. This has cause me to lose this loan and four months of pure hell .

Jim's Reply:

You have a civilian legal problem and the fact that you're a veteran doesn't have anything to do with any of it. Just as any civilian with a real estate dispute, you need to locate legal help in your region.  When we use a VA Loan we aren't really getting a loan from the VA. The VA is guaranteeing that we'll pay the loan and they help to check the whole process as we enter the loan to make sure it's the fair transaction it's supposed to be. Other than that, VA doesn't have anything to do with your realtor, the property you choose and so on.  Any legal issues that might arise are yours to deal with, just as any other civilian would do.

  • PS from Stateside Legal:  Using the "Find Legal Help" directory, look for LRS providers in your State. They should provide you with contact information for a local attorney experienced in real estate closings who can  provide a low-cost consultation to you on your legal rights.
