Income in divorce proceeding

Question:

Does my VA Disability get counted for Alimony? My wife makes 2X what I make with disability and almost 3X without. I do have a normal job.  What do I have to report to the court? I am the respondent.

Jim's Reply:

Read the instructions you receive from the court very carefully. In most states the court will instruct you to state your monthly/yearly income and sources of all income. Your VA disability check is income and that will be counted in your yearly total that the judge will use to determine who owes what to who. While it's true that VA disability can't be garnished, it is standard practice that the income is used to determine obligations in divorce.
