HR 5028 and TDIU benefits

Question:

Jim, have you read HR 5028? It sounds to me that this bill would grant 100% scheduler for those that receiving TDIU.  Is that your take on the bill? Thanks

HR 5028 intends to protect the TDIU rating but I'm not sure I'd go so far as to say it becomes a 100% schedular rating since the TDIU beneficiary won't be allowed to pursue gainful employment. The path to achieve either rating is markedly different even though the end result is much the same. In any case, since you brought it up...this bill won't go anywhere and won't accomplish the goal it was intended to. Over the years many bills have come and gone to take TDIU or other "double-dipper" benefits away and nothing passes...they rarely get out of committee for votes. It's my opinion this is another non-starter.
