Divorce after medical retirement from the military

Question:

I was married to my ex wife when I was medically retired from the military. We were married for 6 years, only 3 of those was I in the military. She is now insisting she has a right to my retirement. Is this true? And my retirement being my VA disability because I am only 33 and “retired”. She is saying she is entitled to money for the rest of her life from me. This cannot be true, can it?

Jim's Reply:

When we divorce we learn that what the parties to the divorce tell each other they will or won't get is rarely true.  The fact is that until the divorce court decides who is entitled to what there are no hard and fast rules to go by. The final arbiter of the divorce is the family court...nobody else has much say in it all.
