Dependent benefits after divorce

Question:

My spouse is 100% service connected and was awarded a Purple Heart, therefore our children are able to have the opportunity of some college education. We are separated...if we would divorce, what does that mean for those education benefits? Would he need to have certain custody for them to still have that opportunity?

Jim's Reply:

Benefits for dependents remain pretty much unchanged after divorce. If he's 100% P & T the children, who will remain as dependents, will be eligible for CHAMPVA health insurance as well as Chapter 35 Dependents Educational Assistance. The degree of custody won't change the dependency relationship.
