90% rating and questions about TDIU

Question:

Hello Jim: I am considering applying for TDIU. I am currently 90 % . I have 60% for my knee with various other disabilities that add up to 90%. My Civilian Doctor is willing to write a letter saying he recommends me to stop working due to my knee and Back. I am rated 20% for my back. with multiple bad disks that will only get worse by being on my feet all day. Disabilities also include my legs that are secondary to back. My wife is worried she wont be covered by VA. Medical if I get 100%. I also was wondering what my chances of getting TDIU are?. I can barely make it through a work day. And can't stop work , need to pay house and bills. I know i am asking many questions, if you can help it will be greatly appreciated. Thank You.

I think your chances of being awarded TDIU are pretty good. I also know from experience that your chances of being denied are pretty good.

I wish I could assure you that you're good to go but I can't. The fact is that if you are employed you are not strictly eligible for TDIU. TDIU is an unemployability benefit...not a  'I want to retire from work' benefit. A 20% rating for a given benefit isn't much to go on when you want to quit the workforce. If you decide to quit, so you can be unemployed and then VA denies you, you've got big problems. Think carefully before you leave a job that you won't be able to replace easily.

The only way your spouse will be covered by VA health insurance is if you do get a 100% P & T rating.
